This document contains all legally required website policies and disclosures for ERCAYO Music Centre, a music education program serving families in Queens and New York City. These policies apply to the ERCAYO website and all enrollment, inquiry, and communication services provided through it.

Terms and Conditions

1. Acceptance of Terms
By accessing or using the ERCAYO Music Centre website (www.ercayo.com) or by enrolling a student in any ERCAYO program, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, please do not use our website or services.
These terms apply to all visitors, registered users, enrolled families, and any other persons who access or use the website or the services offered by ERCAYO Music Centre.
2. Description of Services
ERCAYO Music Centre is a music education program based in Astoria, Queens, New York. We provide:
- Pre-K through High School music instruction, including entry-level, beginner, intermediate, and chamber orchestra tracks
- Individual and ensemble instruction in strings, winds, brass, and other instruments
- Audition preparation coaching for NYC performing arts high schools (Frank Sinatra School of the Arts, LaGuardia High School), All-City ensembles, and competitive youth orchestra programs
- Ensemble and chamber music programming rooted in El Sistema values
- Music enrichment for students already enrolled in NYC performing arts programs
ERCAYO reserves the right to modify, expand, or discontinue any program or service with reasonable notice to enrolled families.
3. Enrollment and Registration
Enrollment in ERCAYO programs is subject to availability, age-appropriate placement, and completion of required registration forms. By submitting an enrollment inquiry or registration form, you confirm that:
- You are the parent or legal guardian of the student being enrolled, or are a student age 18 or older enrolling yourself
- All information provided is accurate and complete
- You have read and agree to these Terms and Conditions and our Privacy Policy
ERCAYO reserves the right to accept or decline any enrollment application at its discretion. Enrollment confirmation is only valid upon receipt of written confirmation from ERCAYO staff.
4. Tuition, Fees, and Payment
Tuition and program fees are communicated at the time of enrollment. By enrolling, you agree to pay all applicable fees according to the payment schedule provided. The following terms apply:
- Tuition is due on the schedule specified in your enrollment agreement
- Late payments may be subject to a late fee
- ERCAYO reserves the right to suspend or terminate enrollment for non-payment
- Fees are subject to change; enrolled families will receive at least 30 days’ written notice of any fee increases
ERCAYO may offer financial assistance, scholarship, or sliding-scale arrangements on a case-by-case basis, consistent with our commitment to equitable access. Please contact us directly to inquire.
5. Refund and Cancellation Policy
Refund requests must be submitted in writing to samva4@gmail.com. The following policies apply:
- Cancellation before the start of an enrollment period: full refund of tuition paid for that period
- Cancellation within the first two weeks of an enrollment period: 50% refund of tuition for that period
- Cancellation after the first two weeks of an enrollment period: no refund
- Registration fees and materials fees are non-refundable
ERCAYO reserves the right to cancel individual classes or program sessions due to instructor illness, weather, or other circumstances beyond our control. In such cases, a make-up class will be offered or a prorated credit applied.
6. Attendance and Make-Up Policy
Regular attendance is essential to student progress and ensemble integrity. Families are expected to:
- Notify ERCAYO at least 24 hours in advance of an absence whenever possible
- Understand that consistent unexcused absences may affect a student’s placement or continued enrollment
Make-up lessons, where offered, are subject to instructor and space availability.
7. Code of Conduct
ERCAYO is committed to maintaining a safe, respectful, and inclusive environment for all students, families, instructors, and staff. All participants agree to:
- Treat all members of the ERCAYO community with respect and dignity
- Refrain from harassment, bullying, discrimination, or any abusive behavior
- Comply with all ERCAYO staff instructions and program rules
- Respect ERCAYO’s equipment, instruments, and facilities
ERCAYO reserves the right to suspend or terminate enrollment of any student whose behavior is deemed harmful to the community, without refund.
8. Supervision and Drop-Off Policy
ERCAYO provides supervision during scheduled program hours only. Parents and guardians are responsible for ensuring timely pick-up of minor students at the end of each session. ERCAYO is not responsible for students who remain on premises after program hours.
9. Media Release and Photo/Video Policy
ERCAYO may photograph or record students during classes, rehearsals, and performances for educational, promotional, and archival purposes. By enrolling, you grant ERCAYO permission to use such images and recordings on our website, social media, and marketing materials, unless you opt out in writing at the time of enrollment.
ERCAYO will never sell student images or recordings to third parties.
10. Instrument and Equipment Policy
Where ERCAYO loans or provides instruments to students, the student and their family accept responsibility for the instrument’s care and safe return. Loss or damage beyond normal wear may result in repair or replacement charges.
11. Intellectual Property
All content on the ERCAYO website, including text, images, logos, curriculum materials, and other content, is the property of ERCAYO Music Centre and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or use of any ERCAYO content is prohibited.
12. Disclaimers and Limitation of Liability
ERCAYO provides its programs and website on an ‘as is’ basis. While we strive to deliver high-quality music education, we do not guarantee specific outcomes, including but not limited to acceptance to any performing arts school, All-City ensemble, or youth orchestra.
To the maximum extent permitted by applicable law, ERCAYO shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services or website.
13. Changes to These Terms
ERCAYO reserves the right to update or modify these Terms and Conditions at any time. Enrolled families will be notified of material changes by email. Continued enrollment following notification constitutes acceptance of the revised terms.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the State of New York. Any disputes arising from or relating to these terms or ERCAYO services shall first be addressed through good-faith communication with Samuel Marchan at samva4@gmail.com. If not resolved, disputes shall be subject to the jurisdiction of the courts of Queens County, New York.

Refund and Cancellation Policy

This policy applies to tuition payments and program fees paid to ERCAYO Music Centre.
Program Cancellation by Family
- Cancellation before the start of an enrollment period: full refund of tuition paid for that period
- Cancellation within the first two weeks: 50% refund of tuition for that period
- Cancellation after the second week: no refund
- Registration fees and materials fees are non-refundable
Individual Class Cancellation
- Families who miss individual classes due to student illness or emergency, with 24-hour advance notice, may be offered a make-up session subject to availability
- No-shows without advance notice are not eligible for make-ups or credits
Program Cancellation by ERCAYO
If ERCAYO cancels a class due to instructor illness, weather, or circumstances beyond our control, families will receive a make-up session or a prorated credit. If ERCAYO discontinues a program, a full prorated refund of unused tuition will be issued.
Financial Hardship
Families experiencing financial difficulty are encouraged to contact us before withdrawing. We are committed to working with families to maintain student participation wherever possible.

Children’s Privacy Notice (COPPA)

We Do Not Collect Children’s Data Directly Online

Third-Party Photography
Families attending ERCAYO events may photograph their own children. Photography of other students without the knowledge of their families is discouraged. Commercial or media photography at ERCAYO events requires advance written permission.
